Overview of the applicant and the trademark YUASA CO., LTD. (the applicant) is a Japanese trading company with a history of 360 years. The applicant started business as a charcoal merchant. In its fifth year, the applicant switched its business line to wholesaling cutting tools. It was the first innovation that the applicant made, which set the stage for starting the business of handling machines, tools, and equipment, a business that has lasted for 360 years and counting. Since then, the applicant has taken on the challenge of creating innovation as a pioneer in the industry. The applicant harnesses its total coordination skills to take on challenges in four fields: Manufacturing, Home Building, Environment Building, and Town Building, and promotes initiatives to address social issues both in Japan and overseas. Its core businesses include the Industrial Equipment & Tools Division, Machine Tools Division, Housing, Air and Fluidic Control Systems Division, Building Supplies & Exterior Division, and Construction Machines Division, as well as other areas such as energy, consumer products, and lumber. The applied-for string "yuasa" is our brand name and fully meets the .Brand TLD criteria defined in Specification 13, Section 9. The string is (i) identical to the textual elements of our registered trademark "yuasa", (ii) actually used by us in the ordinary course of our business, as shown here: https://www.yuasa.co.jp/en/, and (iii) supported by a trademark registration issued prior to the filing of this TLD application (registration date: 1996-04-30; record: https://www.j-platpat.inpit.go.jp/c1801/TR/JP-1992-174543/40/ja ). The trademark is also recorded with the Trademark Clearinghouse (TMCH) and associated with a valid SMD file. Because our applied-for string satisfies all Specification 13 criteria, it is not a Generic String under Specification 11. Therefore, Specification 11 Section 3(d) does not apply. To ensure that our applied-for string continues to qualify as a .Brand TLD and thus remains outside the scope of Specification 11 Section 3(d), we will conduct at least one annual internal review in accordance with Specification 13 Section 7 and will submit the review results together with an officer’s certification to ICANN within 20 calendar days after each calendar year.
